Reasons for an Annulment

Not every marriage will qualify for an annulment. To be eligible, it must be shown in court that the marriage was never legally valid. While every situation will be different, an annulment can occur for a variety of reasons.

  • Close Blood Relatives
  • An Existing Marriage
  • Underage Marriage
  • Use of Fraud or Force
  • Unsound Mind
  • Physical Incapacity

Frequently Asked Questions

  • Questions

  • How Do Annulment and Divorce Differ?

    Answer

While both annulment and divorce act to terminate a marriage, they have striking differences. An annulment works to nullify a marriage; legally, it’s as if it never happened. Divorce, on the other hand, can have lasting legal implications which may affect spouses for years to come.

  • Can an Annulment Be Denied if both Spouses Agree?

    Answer

Yes. It is not enough for both parties to agree to an annulment. For an annulment to be granted by a court, a marriage must meet at least one of several specific requirements. If this is not the case, spouses may be left to explore other legal options such as a divorce.

  • How Long Will it Take to Get an Annulment?

    Answer

Frustratingly, there is no simple answer to this question. If the annulment is uncontested, the process can be relatively quick. However, if one party disputes the motion, it can add a substantial amount of time to the process. To learn more about your specific situation, do not hesitate to contact our law firm.

  • Should I Hire an Attorney?

    Answer

Pursuing an annulment can be a complex matter; even a seemingly simple mistake can lead to the denial of a motion. With so much on the line, you can’t afford to leave anything to chance. Experienced legal advocates like those at our firm, can help you protect your interests every step of the way. Call us today and discover how we can help.
