Frequently Asked Questions

Questions
-
What If I have a Marital Agreement?
Answer
While a marital agreement can be a helpful tool in the case of a divorce, a signed document doesn’t guarantee its enforceability. There are numerous requirements an agreement must meet to be upheld in court. If you have an existing agreement, it is highly recommended that you review its terms with an attorney from our firm.
-
What If My Spouse Is Hiding Assets?
Answer
The accurate reporting of property is a vital component in the distribution of property. However, a spouse may not always be playing by the rules. It is against the law to attempt to conceal or hide assets in a divorce and if you believe your spouse has done so, do not waste any time in contacting our legal team.
-
Should I Hire an Attorney?
Answer
Whether you are pursuing an uncontested divorce or if litigation has become the only path forward, it is critical to consult with an experienced legal advocate, like those from our firm. We know where the common pitfalls lie and can work tirelessly to help you avoid them.
-
How Long Will My Divorce Take?
Answer
Frustratingly, there is no simple answer to this question. If the divorce is uncontested, the process can be relatively quick. However, if one party disputes the motion, it can add a substantial amount of time to the process. To learn more about your specific situation, do not hesitate to contact our law firm.

David Kellem
Founding Attorney
David Kellem's strengths in family law draw from his broad legal background. Before founding Kellem Mahoney Family Law & Mediation Group, he spent 25 years representing clients in a wide range of areas that relate to family law.
In addition, David has training in criminal law. This experience informs his representation of clients in restraining order and abuse cases. From 1983 to 1987, he prosecuted street-crime cases in Manhattan as an assistant district attorney with the New York County District Attorney’s Office. His work included jury trials, grand jury presentations and appeals involving cases of murder, robbery, narcotics sales, burglary, weapons possession and sexual assault.
After earning a bachelor’s degree from Georgetown University, David graduated with honors from Suffolk University Law School in 1981. He honed his writing skills as lead article editor of the Suffolk University Law Review and after graduation as a law clerk to the Honorable Joseph R. Weisberger of the Rhode Island Supreme Court.
